1. Agreement to these terms
By creating an account, connecting a social account, or otherwise using Moonwind’s website, application, APIs, and related services (the “Service”), you agree to these Terms of Service and our Privacy Policy. If you use Moonwind for an organization, you confirm that you have authority to bind that organization.
If you do not agree, do not use the Service or authorize Moonwind to access a social account.
2. Eligibility and accounts
You must be at least 18 years old and legally able to enter into this agreement. You must provide accurate information, maintain control of your sign-in method, and promptly notify us of suspected unauthorized access.
You are responsible for actions taken through your Moonwind account and for ensuring each workspace user has permission to access the connected brands, Pages, channels, and social accounts.
3. Connected platforms
Moonwind lets you connect supported third-party services such as Google, YouTube, X, Facebook, and Instagram. You authorize Moonwind to access and process provider data only within the permissions you grant and to send instructions to the provider when you explicitly publish, reply, synchronize, or otherwise use a connected feature.
Your use of each provider remains subject to its own terms, policies, quotas, reviews, and technical limits. Moonwind is not affiliated with or endorsed by those providers, and a provider may change, suspend, or withdraw API access at any time.
4. Your content and instructions
You retain ownership of content you submit or connect to Moonwind. You give Moonwind a limited, non-exclusive license to host, process, format, transmit, and display that content only as needed to provide, secure, and improve the Service.
You are responsible for confirming the audience, account, text, media, timing, and legal right to publish before submitting an action. Moonwind will not intentionally publish or reply without an authorized user action, but you remain responsible for content sent through your accounts.
5. Acceptable use
You may not use Moonwind to:
- Violate law, intellectual-property rights, privacy rights, provider rules, or contractual obligations.
- Publish spam, deceptive content, malicious code, harassment, unlawful discrimination, or content that facilitates harm.
- Access accounts, messages, analytics, or personal information without authorization.
- Scrape, probe, overload, bypass limits, reverse engineer, or interfere with the Service or its security.
- Sell, sublicense, or use provider data for surveillance, credit decisions, data brokerage, or unauthorized advertising.
- Misrepresent Moonwind, impersonate another person, or conceal the origin of automated activity.
6. Beta features and service changes
Moonwind is evolving and some features may be identified as beta, preview, or limited availability. Such features may be incomplete, contain errors, or change without notice. We may add, modify, suspend, or discontinue features to address provider changes, security, compliance, cost, or product needs.
Do not rely on Moonwind as the sole archive for social content, messages, analytics, or business records. Maintain independent copies of information your organization must preserve.
7. Fees
Moonwind may offer free, trial, or paid functionality. We will display applicable pricing and obtain authorization before charging you. Unless otherwise stated at purchase, fees are non-refundable except where required by law. You are responsible for taxes associated with your purchase.
8. Intellectual property and feedback
Moonwind and its software, design, branding, documentation, and underlying technology are protected by intellectual-property laws. Except for the limited right to use the Service under these terms, no rights are transferred to you.
If you provide feedback, you allow us to use it without restriction or compensation, provided we do not publicly identify you without permission.
9. Suspension and termination
You may stop using Moonwind and disconnect provider accounts at any time. We may restrict or suspend access where reasonably necessary to protect users or platforms, investigate misuse, comply with law or provider requirements, prevent security harm, or address material violations of these terms.
After termination, provisions that by their nature should continue—including ownership, disclaimers, liability limitations, and dispute terms—remain effective. See Data Deletion for removal instructions.
10. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” Moonwind disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
Analytics and competitor signals may be delayed, incomplete, estimated, or unavailable because of provider data and API limitations. They are informational and should not be treated as legal, financial, or guaranteed business advice.
11. Limitation of liability
To the maximum extent permitted by law, Moonwind will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost revenue, profits, goodwill, data, or business opportunities arising from the Service, connected platforms, or unauthorized use of an account.
Where liability cannot be excluded, Moonwind’s aggregate liability for claims relating to the Service will not exceed the amount you paid Moonwind for the Service during the three months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so those limitations apply only to the extent lawful.
12. Changes and contact
We may update these terms to reflect feature, provider, security, or legal changes. We will update the effective date and provide reasonable notice of material changes. Continued use after an updated version becomes effective constitutes acceptance where permitted by law.
